We, MAQE Bangkok Co., Ltd, (“MAQE” or “Company”) places great importance on protecting your personal information. This privacy notice explains the policies for collecting, using, or disclosing personal information. It also explains various rights of Data Owner. According to the Personal Data Protection Act B.E. 2019

1. How the Company Collects and Receives Your Personal Data

1.1 Personal Data which you directly provide to the Company

You may directly provide your personal data to the Company, such as when you submit job application forms and additional documents for job application to the Company whether by walk-in, apply at job application booth, apply through the Company’s website and including in the event that you attend a job interview, enter into a contract with the Company, and submit documents containing your personal data to the Company, etc.

1.2 Personal Data which the Company automatically collects from you

The Company may collect your personal data by automated means, such as the use of Cookies or other similar technologies. For more details, please see the Company’s Cookie Policy.

1.3 Personal Data which the Company receives from third parties

The Company may receive your personal data from third parties, such as job application website of a third party, your reference person, recruitment company, government agency, educational institution, social media source, or job application form and/or documents of persons related to you as you are a family member, persons who may be contacted in case of emergency, reference person, beneficiary, or guarantor of such person, etc.

2. Collected Personal Data

Personal information, such as first name, last name, age, date/month/year of birth, sex, weight, height,  nationality, race, religion,  identification number, passport number, photograph, signature, marital status, military status, family member details (such as father, mother, spouse, and children, etc.), health condition, and biometric data (such as fingerprint, palm print, iris recognition and face simulation, etc.), etc.

Contact information, such as address, telephone number, fax number, e-mail, Line ID, and emergency contact person details, and reference person details etc.

Information that is used as supporting evidence in execution of juristic acts, such as Personal Data which appears in a copy of the national identification card, copy of passport, copy of change of name certificate, copy of house registration book, copy of military service certificate, copy of bank account book, copy of marriage certificate, copy of birth certificate, social security application form, letter of consent for personal background check, result of personal background check, employment contract, and power of attorney, etc.

Information on education and training, such as academic and training background (such as institution name, faculty, program, and year of graduation, etc.), academic certificate, transcript, language skills, computer skills, training and test details, and activities participated during the time of study, etc.

Information on work history, such as Work Permit, personal profile, working experience, details in resume/CV, criminal record, position applied, expected salary, interviewed details, evidence or reference documents, and details as appeared in the interview assessment form (such as assessment results, knowledge and experience, personal characteristics, teamwork, and working potentials), starting date, probation end date, resignation date, details as appeared in the performance review process, leave record, sick record, etc.

Information on benefits and remuneration, such as salary, wages, reward, welfare, bank account number, social security details, provident fund details, tax details, tax deduction details, health benefits details (including for family members) and/or other benefits, personal data which appears in medical certificates, salary reduction consent letters, receipts, invoices, and compensation request forms (for accident and life insurance), etc.

Technical information, such as IP Address, CCTV record, and information that the Company collects through Cookies or other similar technologies, etc.

Other information, such as Car license Plate no., Photographs, etc.

MAQE may collect, use, or disclose the following sensitive personal data only when we have received consent to do so from you unless the law allows it to be done without the consent of the data owner.

  • Ethnicity
  • Race
  • Criminal Records
  • Labor Union Records
  • Health Records
  • Disability 
  • Biometrics Information, such as face simulation, iris recognition, fingerprint, etc.

and any other information that affects the data owner in the same manner as announced by the Board of Personal Data Protection.

3. Processing of Personal Data

MAQE collects, uses, or discloses your information for the following purposes

  • For processing of Employee Contracts
  • For processing of the Non-Disclosure Agreement (NDA)
  • For communication with Employees and those related to the employee
  • For processing salary, compensation, benefits, tax deduction, social security, any salary withholding as required by Governmental Agencies, and all other related expenses.
  • For personnel management, such as managing leave days as specified by law and the company, training records, performance review records, etc.
  • For compliance with the laws and legitimate orders of government agencies, such as the Social Security Office, Revenue Department, courts, and other government agencies
  • For security purposes, such as CCTV record, fingerprint access, etc.
  • For establishment, compliance, exercise, or defense of legal claims of the Company
  • For any other purposes as notified by MAQE

4. Disclosure of Personal Data

The Company may disclose your personal data in accordance with the purposes and the rules prescribed under the laws to the following entities and persons:

4.1 In-house personnel

The Company may disclose your information with relevant in-house personnel of the Company as necessary on a need-to-know basis for Processing your personal data for the benefit of you and others.

4.2 Relevant governmental agencies which have supervisory duties under the laws

The Company may disclose your personal data when relevant governmental agencies have requested the disclosure under their lawful powers or relevant to the legal process or which were granted permission pursuant to applicable laws, such as Department of Labour Protection and Welfare, Department of Skill Development, Department of Empowerment of Persons with Disabilities, Social Security Office, Department of Provincial Administration, Department of Business Development, Department of Intellectual Property, Office of the Personal Data Protection Commission, Office of Trade Competition Commission, Royal Thai Police, Office of the Attorney General, court, and Legal Execution Department, etc.

4.3 Business partners

The Company may disclose your personal data to customers, vendors, contracting parties of the Company which you have contacted or are relevant to your duty or position, or any other persons in similar manners.

4.4 Service Providers

The Company may disclose your Personal Data to service providers, and data processors designated or hired by the Company to perform duties in connection with the management/Processing of Personal Data for the Company in the provision of various services, such as employee’s medical check by business partners, information technological services, data recording services, payment services, mailing services, delivery services, printing services, health services, insurance services, training services, data analysis services, research services or any other services which may be beneficial to you or relevant to the Company’s business operation, such as commercial bank, hospital, life insurance company, and non-life insurance company, inclusive advisors of the Company, such as legal advisors, lawyers, auditors, or any other internal and external experts of the Company, etc.

4.5 Business Transfer

The company may disclose your information, including personal data, in connection with organizational restructuring, mergers, or sales of business assets. The receiving party must handle your data in a manner that is consistent with this policy, including adherence to personal data protection laws.

4.6 Any other

The company may disclose information, including your personal data in accordance with other Company policies, such as for organizational restructuring, merger or divestiture, or any other transfer of assets. The counterparties must treat your data in a manner consistent with this Policy and Personal Data Protection laws.

Furthermore, the company can disclose information to any other persons or any other entities to whom you have given consent to disclose your personal data to.

5. International Transfer of Personal Data

The Company may disclose or transfer your personal information to individuals, organizations, or servers located abroad. The Company will take various measures to ensure that the transfer of your personal data to the destination country has adequate standards of personal data protection or other cases as required by law.

6. Retention Period

The Company will retain your personal data for the period necessary to fulfill the purposes for which the personal data was processed, whereby the retention period will vary depending on the purposes for which such personal data was collected and processed. The Company will retain personal data for the period prescribed under the applicable laws (if any), considering the legal statute of limitations for potential litigation arising from or related to the documents or personal data collected by the company. This is also taking into account the company’s practices and those of the relevant industry for each type of personal data.

In this regard, the Company will retain your personal data for a period not exceeding 10 years, starting from the date your legal relations/transactions with the Company come to an end. However, the Company may retain your personal data for a longer period of such time prescribed if the laws permit or such retention of personal data is necessary for the establishment of the right of claim of the Company.

After the period of time set forth above has expired, the Company will delete or destroy such personal data from the storage or system of the Company and other persons providing services to the Company (if any) or anonymize your personal data, unless in the event that the Company can continue to retain such personal data as prescribed by the Laws on Personal Data Protection or other applicable laws.

7. Your Rights

7.1 Right of Access

You have the right to access and obtain a copy of your personal data or request to disclose your personal data. The request must be in writing and sent to the channel provided in the “CONTACT US” section. Your request will be processed within the period required by law. We may, to the extent permitted by law or court order, refuse to act on your request where such a request could affect the rights and freedom of another person.

7.2 Right to Rectification

You have the right to request that any personal data about you that the company processes be corrected to be complete, accurate, not misleading, and up-to-date.

7.3 Right to Data Portability

You may have the right to receive your personal data that the company holds in an organized electronic format and to transmit that data to another personal data controller, provided that (a) it is personal data that you have provided to the company, and (b) the company processes that data based on your consent

7.4 Right to Object

You have the right to object to the collection, use, or disclosure of your personal data which aims to achieve the legitimate interests of the company (or someone else). The company may refuse to comply with your request if it can demonstrate that there are lawful reasons for the collection, use, or disclosure of personal data that are more significant than your interests, or if the collection, use, or disclosure is necessary for the establishment, exercise, or defense of legal claims.

7.5 Right of Erasure

You have the right to request the company to delete or destroy your personal data, or to make it anonymous if you believe that (1) the personal data is no longer necessary for the purposes specified in this notification, or (2) your personal data has been collected, used, or disclosed unlawfully. However, the company may refuse to comply with a request to delete or destroy your personal data if it is necessary for the establishment, exercise, or defense of legal claims, or for compliance with legal obligations.

7.6 Right to Restrict Processing

You have the right to request the company to suspend the use of your personal data if you believe that the company no longer needs to retain the data for the purposes specified in this notification, but you still want it to be retained for the establishment, exercise, or defense of legal claims, or for compliance with legal obligations.

7.7 Right to Withdraw Consent

If you have given consent to the company to collect, use, or disclose your personal data, you have the right to withdraw that consent at any time. 

7.8 Right to Complain

You have the right to lodge a complaint against the company with the supervisory authority responsible for personal data protection if you believe that the company has violated or failed to comply with any of its duties under the personal data protection laws that are in force.

You can exercise your rights as the owner of personal data above, by contacting the Company which details are at the end of this notice. The Company will notify you of the results of your requests within 30 days from the date the Company receives your request with the form or method specified by the Company. If the company rejects the request the Company will inform you of the reason for refusal through various channels such as text message (SMS), email, telephone, letter, etc.

8. The Security of Personal Information

The company will maintain the security of your personal data by adhering to the principles of confidentiality, integrity, and availability. This is to prevent loss, unauthorized access, use, alteration, modification, or disclosure.

Additionally, the company will implement measures to secure personal data, which include administrative safeguards, technical safeguards, and physical safeguards, particularly concerning access control or regulation of personal data usage.

9. Notification of Personal Data Breach

In the event of a violation of your personal information, the Company will notify the Office of the Personal Data Protection Commission without delay within 72 hours after the Company becomes aware of the breach. Where the breach has a high risk of adversely affecting your rights and freedoms, the Company will notify you of the violation along with remedies without delay through various channels such as the Company website, SMS, email, telephone, letter, etc.

10. Changes to This Privacy Policy

The Company may make changes to this Privacy Policy from time to time to reflect any changes to our processing of your personal data and to comply with the changes to the Laws on Personal Data Protection or any applicable laws. In this regard, the Company will notify you of any significant changes to the Privacy Policy and the amended Privacy Policy through appropriate means. The Company encourages you to review such communication in order to be aware of any changes made to this Privacy Policy from time to time.
